1. About us

This website is operated by Branching Out Tree Surgery Landscaping & Gardening Ltd (“we”, “us”, “our”), 68 Ffordd Pennant, Meliden, Prestatyn, LL19 8PE. We provide tree surgery, hedge cutting, landscaping, fencing, patios, decking, grounds maintenance, site clearance and vegetation management services across North Wales.

2. Use of this website

By using this website you agree to these terms. You must not use the website for any unlawful purpose, attempt to gain unauthorised access to any part of it, or copy, reproduce or distribute its content without our permission. We may restrict or withdraw access to the website at any time.

3. Information on this website

The information on this website is for general guidance only. Descriptions of services, methods and prices may change without notice, and nothing on the website is a binding offer or quotation. Advice about a specific tree, hedge or garden can only be given after we have seen it.

4. Quotations and pricing

  • Quotations are free and are provided in writing after a site visit or, for small jobs, from photographs and a description.
  • Written quotations are valid for 30 days unless otherwise stated.
  • Prices are based on the site conditions, access and scope of work seen or described at the time of quoting. If conditions differ, for example hidden obstructions, services, contaminated ground or additional work requested on site, we will tell you before proceeding and agree any change in price.
  • Unless the quotation says otherwise, prices include removal of green waste arising from the work and exclude any fees payable to third parties such as local authority permissions or traffic management.

5. Bookings and access

  • Dates and times are given in good faith but may change because of weather, emergency call-outs or circumstances beyond our control. Tree work in particular cannot be carried out safely in high winds or heavy rain and may need to be rescheduled at short notice.
  • You must ensure we have safe and clear access to the site and that vehicles, garden furniture, pets and other items are moved away from the working area before we arrive.
  • You must tell us before work starts about anything you know of that could affect safety, including underground services, septic tanks, drains, ponds, overhead cables and the location of boundaries.

6. Tree work, permissions and neighbours

  • Trees may be protected by a Tree Preservation Order or by being in a conservation area. Unless we have agreed in writing to check and apply on your behalf, you are responsible for confirming that the work you ask us to carry out is permitted. We will not carry out work we know to be unlawful.
  • You confirm that you own the trees, hedges and land we are asked to work on, or have the owner’s permission. Work to trees on or overhanging a neighbour’s land needs the neighbour’s agreement, and we may ask to see it.
  • We will check for nesting birds, bats and other protected wildlife before starting and may delay or change the work if any are found.
  • Timber and logs remain your property and will be left on site cut into manageable lengths unless removal has been agreed.

7. Payments

Payment terms are stated on your quotation or invoice. For larger projects and where materials have to be ordered we may ask for a deposit before work starts, with the balance due on completion. Invoices are payable within 7 days unless otherwise agreed. We may charge interest and reasonable recovery costs on overdue amounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 for business customers.

8. Cancellations

You may cancel or rearrange a booking by giving us reasonable notice, ideally at least 48 hours. Where materials have been ordered or cut for your job, or where we arrive on site and cannot start work because access has not been provided, we may charge for the costs we have incurred. If you are a consumer who agreed the contract away from our premises, you may have a legal right to cancel within 14 days; details will be provided with your quotation.

9. Waste and materials

We remove green waste and other materials arising from our work as a registered waste carrier, or chip it on site for your use where agreed. Materials we supply, such as fencing, paving and decking, remain our property until paid for in full. Manufacturer guarantees on supplied materials are passed on to you.

10. Our workmanship

We carry out all work with reasonable skill and care, to recognised industry standards and to the specification agreed with you. If you are not satisfied with any aspect of our work please tell us as soon as possible so that we can put it right. Our Complaints Policy explains how we handle complaints.

11. Liability

We hold public liability and employers’ liability insurance and will be responsible for damage caused by our negligence. We are not responsible for pre-existing defects, for damage to underground services or structures whose location was not disclosed to us, for the natural response of trees and plants to pruning, or for indirect or consequential losses. Nothing in these terms limits our liability for death or personal injury caused by our negligence or for anything else that cannot be limited by law. Your statutory rights as a consumer are not affected.

12. Intellectual property

The content of this website, including the Branching Out logo, text and photographs, belongs to Branching Out Tree Surgery Landscaping & Gardening Ltd or its licensors and may not be used without permission.

13. External links

This website links to third-party websites, including Facebook. We are not responsible for their content or their handling of your information.

14. Privacy

Your use of this website is also governed by our Privacy Notice and our Data Protection Policy.

15. Changes to these terms

We may update these terms at any time by publishing a new version on this page. The terms that apply to a job are those in force when the quotation was accepted.

16. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.
